Independent Captain Services Agreement & Liability Waiver

1. INDEPENDENT CAPTAIN SERVICES. The Captain agrees to provide captain/navigation services as an independent contractor for the Client's vessel or bareboat charter on the agreed date and time. The Captain is independently selected by the Client and is not an employee, agent, or representative of any vessel owner or Beer Can Island Owners Club LLC.

2. CAPTAIN QUALIFICATIONS. The Captain represents that they hold a valid United States Coast Guard (USCG) captain's license appropriate for the vessel and waters, maintain all required certifications, and carry any insurance required by law.

3. CLIENT RESPONSIBILITIES. The Client acknowledges that: (a) the Client independently selected this Captain from available options; (b) the Captain is paid separately by the Client, not as part of a vessel rental; (c) the Client retains full legal possession of the chartered/rented vessel; (d) all passengers will follow the Captain's safety instructions; (e) the Client is responsible for ensuring the vessel is properly insured.

4. SCOPE OF SERVICE. The Captain will provide: safe navigation and operation of the vessel, knowledge of local waters and conditions, compliance with all maritime laws and USCG regulations, and passenger safety briefings. The Captain retains authority to refuse departure or terminate the trip if conditions are unsafe.

5. PAYMENT & CANCELLATION. Payment terms and cancellation policies are set by each individual Captain and displayed during booking. Captain cancellation or unsafe weather: full refund.

6. INDEPENDENT CONTRACTOR STATUS. The Captain is an independent contractor, not an employee of the Client, any vessel owner, or BCI. The Captain is responsible for their own taxes, insurance, and compliance with all applicable laws.

7. ASSUMPTION OF RISK & LIABILITY WAIVER. I understand that boating activities involve inherent risks including drowning, collision, weather hazards, equipment failure, and personal injury or death. I VOLUNTARILY ASSUME ALL SUCH RISKS and release Pine Key Tampa Bay LLC, Beer Can Island Owners Club LLC, Tiki Bay Island LLC, and all of their respective owners, members, managers, officers, directors, board members, shareholders, equity holders, employees, agents, contractors, affiliates, successors, assigns, heirs, executors, family members, and insurers (collectively, the "Protected Parties") from any and all liability for injury, death, or property damage arising from the captain services provided, whether caused by negligence or otherwise.

8. INDEMNIFICATION. I agree to indemnify and hold harmless all Protected Parties from any claims arising from the condition of the vessel, actions of passengers, or any matter outside the Captain's direct control.

9. INSURANCE. Neither BCI nor any Protected Party provides any insurance coverage of any kind. The Client is solely responsible for vessel insurance, liability coverage, and personal insurance for all passengers.

10. PLATFORM DISCLAIMER. Beer Can Island Owners Club LLC, Pine Key Tampa Bay LLC, and Tiki Bay Island LLC (collectively, "BCI") act solely as a booking platform connecting clients with independent captains. BCI does not employ, supervise, or control any captain and assumes no liability for captain services, vessel condition, or any acts or omissions of any captain.

11. GOVERNING LAW. Governed by Florida law. Disputes resolved in Hillsborough County. Jury trial and class action rights waived.
