1. RENTAL. The Operator agrees to rent the personal watercraft (PWC/jet ski) to the Renter for the agreed duration. The Renter acknowledges receiving a safety briefing and orientation prior to operation.
2. RENTER QUALIFICATIONS. The Renter represents that they: (a) are at least 18 years of age (or accompanied by a legal guardian who co-signs); (b) can swim; (c) are physically capable of operating a PWC; (d) are not under the influence of alcohol, drugs, or any substance that may impair judgment; (e) hold any boater safety certification required by Florida law for PWC operation.
3. FLORIDA PWC LAWS. The Renter acknowledges: (a) PWC may only be operated between sunrise and sunset per Florida law; (b) a boater safety ID card is required for operators born on or after January 1, 1988; (c) all riders must wear a USCG-approved life jacket at all times; (d) the lanyard kill switch must be attached to the operator at all times; (e) reckless or negligent operation is a criminal offense under Florida Statute 327.33.
4. RULES OF OPERATION. The Renter agrees to: (a) operate at safe speeds and maintain proper lookout; (b) stay within designated operating areas; (c) maintain minimum 300ft distance from other vessels, swimmers, and fixed objects; (d) not perform stunts, jumps, or aggressive maneuvers; (e) not allow any unlicensed or unauthorized person to operate the PWC; (f) immediately report any mechanical issues; (g) return the PWC at the agreed time with all equipment.
5. DAMAGE & FINANCIAL RESPONSIBILITY. The Renter is financially responsible for any damage to the PWC, including hull, engine, impeller, and all equipment, occurring during the rental period regardless of cause. The Renter's credit card on file may be charged for repairs, replacement, towing, or salvage costs.
6. PAYMENT & CANCELLATION. Payment terms and cancellation policies are set by each individual Operator and displayed during booking. Operator cancellation or unsafe weather: full refund.
7. ASSUMPTION OF RISK & LIABILITY WAIVER. I understand that personal watercraft operation is an EXTREME ACTIVITY involving significant inherent risks including but not limited to: drowning, high-speed collision, ejection, impact with submerged objects, marine life encounters, propeller injuries, burns, hearing damage, spinal injuries, and death. THESE RISKS CANNOT BE ELIMINATED. I VOLUNTARILY ASSUME ALL SUCH RISKS and hereby release, waive, and forever discharge Pine Key Tampa Bay LLC, Beer Can Island Owners Club LLC, Tiki Bay Island LLC, and all of their respective owners, members, managers, officers, directors, board members, shareholders, equity holders, employees, agents, contractors, affiliates, successors, assigns, heirs, executors, family members, and insurers (collectively, the "Protected Parties") from any and all liability, claims, demands, and causes of action for injury, death, or property damage arising from my rental and operation of this PWC, whether caused by negligence or otherwise.
8. INDEMNIFICATION. I agree to indemnify and hold harmless all Protected Parties from any claims, damages, or expenses arising from my operation of the PWC or the actions of any rider during the rental.
9. INSURANCE. Neither Beer Can Island Owners Club LLC, Pine Key Tampa Bay LLC, nor Tiki Bay Island LLC provide any insurance coverage of any kind. The Renter is solely responsible for obtaining any insurance they deem necessary. Proof of insurance is not required.
10. PLATFORM DISCLAIMER. Beer Can Island Owners Club LLC, Pine Key Tampa Bay LLC, and Tiki Bay Island LLC (collectively, "BCI") act solely as a booking platform. BCI does not own, operate, inspect, or maintain any PWC or equipment and assumes no liability for any PWC, its condition, or any incidents during rental.
11. GOVERNING LAW. Governed by Florida law. Disputes resolved in Hillsborough County. Jury trial and class action rights waived.
