Bareboat Rental Agreement & Liability Waiver

1. BAREBOAT CHARTER. This is a bareboat (demise) charter. The Owner agrees to deliver the vessel to the Renter in good operating condition. The Renter takes full possession, command, and control of the vessel for the rental period. No captain or crew is provided by the Owner.

2. RENTER QUALIFICATIONS & RESPONSIBILITIES. The Renter represents that they: (a) are at least 18 years of age; (b) possess sufficient knowledge, skill, and experience to safely operate the vessel; (c) hold any licenses or certifications required by Florida law; (d) will operate the vessel in compliance with all applicable federal, state, and local laws, including U.S. Coast Guard regulations. The Renter assumes full responsibility for the safe operation, navigation, and management of the vessel and all persons aboard.

3. INDEPENDENT CAPTAIN. If the Renter wishes to hire a captain, the Renter shall independently select and pay the captain separately. The captain is the agent and employee of the Renter, not the Owner. The Owner does not mandate, recommend, or control any hired captain.

4. PROHIBITED USES. The Renter agrees NOT to: (a) transport passengers or merchandise for hire; (b) sub-charter or transfer the vessel; (c) operate the vessel under the influence of alcohol or drugs; (d) exceed the maximum passenger capacity; (e) operate in restricted or hazardous waters; (f) tow other vessels or persons without proper equipment; (g) allow any unlicensed minor to operate the vessel.

5. VESSEL CONDITION & RETURN. The Renter acknowledges inspecting the vessel prior to departure and accepts it in its current condition. The Renter agrees to return the vessel at the agreed time and location in the same condition as received, ordinary wear and tear excepted. Late returns will incur additional charges.

6. DAMAGE & SECURITY DEPOSIT. The Renter is financially responsible for any and all damage to the vessel, its equipment, engine, hull, and furnishings occurring during the rental period, regardless of cause. A security deposit may be held and applied against damages.

7. SAFETY EQUIPMENT. The Owner confirms the vessel is equipped with required safety equipment including life jackets for all passengers, fire extinguisher, and distress signals. The Renter is responsible for ensuring all passengers are briefed on safety equipment locations and use. Persons under 13 must wear a life jacket at all times.

8. PAYMENT & CANCELLATION. Payment terms, deposit requirements, and cancellation policies are set by each individual vessel Owner and displayed during booking. Owner cancellation or unsafe weather: full refund.

9. ASSUMPTION OF RISK & LIABILITY WAIVER. I understand that operating a watercraft involves extreme inherent risks including but not limited to: drowning, collision, capsizing, grounding, weather hazards, marine life, equipment failure, and personal injury or death. AS THE OPERATOR OF THE VESSEL, I VOLUNTARILY ASSUME ALL SUCH RISKS and hereby release, waive, and forever discharge Pine Key Tampa Bay LLC, Beer Can Island Owners Club LLC, Tiki Bay Island LLC, and all of their respective owners, members, managers, officers, directors, board members, shareholders, equity holders, employees, agents, contractors, affiliates, successors, assigns, heirs, executors, family members, and insurers (collectively, the "Protected Parties") from any and all liability, claims, demands, and causes of action for injury, death, or property damage arising from or related to my rental and operation of this vessel, whether caused by negligence or otherwise.

10. INDEMNIFICATION. I agree to indemnify and hold harmless all Protected Parties from any and all claims, damages, losses, or expenses (including attorney's fees) arising from my operation of the vessel or the actions of any person aboard during the rental period.

11. INSURANCE. Neither Beer Can Island Owners Club LLC, Pine Key Tampa Bay LLC, nor Tiki Bay Island LLC provide any insurance coverage of any kind. The Renter is solely responsible for obtaining any insurance they deem necessary. Proof of insurance is not required.

12. PLATFORM DISCLAIMER. Beer Can Island Owners Club LLC, Pine Key Tampa Bay LLC, and Tiki Bay Island LLC (collectively, "BCI") act solely as a booking platform. BCI does not own, operate, inspect, or maintain any vessel and assumes no liability for the vessel's condition, seaworthiness, or any incidents during the rental period.

13. GOVERNING LAW. This agreement is governed by the laws of the State of Florida. Disputes shall be resolved in Hillsborough County, Florida courts. Jury trial and class action rights are waived.
