Crewed Charter Agreement & Liability Waiver

1. SERVICES. The Charter Operator agrees to provide a crewed charter service on the vessel, including a USCG-licensed captain and any crew as specified, on the agreed date and time, subject to weather and safety conditions at the captain's sole discretion.

2. VESSEL & CREW. The Charter Operator warrants that the vessel is in seaworthy condition, properly equipped with all required safety equipment including life jackets, fire extinguisher, and first aid kit, and that the captain holds a valid USCG captain's license. The captain retains full authority over vessel operation, navigation, passenger safety, and may terminate the trip at any time if conditions are deemed unsafe.

3. PASSENGER RESPONSIBILITIES. All passengers agree to: (a) follow all instructions from the captain and crew; (b) wear life jackets when directed; (c) refrain from interfering with vessel operation; (d) not bring illegal substances aboard; (e) report any medical conditions that may affect participation. Persons under 13 must wear a life jacket at all times while aboard.

4. PAYMENT & CANCELLATION. Payment terms, deposit requirements, and cancellation policies are set by each individual Charter Operator and displayed during booking. Captain cancellation or unsafe weather conditions: full refund.

5. ASSUMPTION OF RISK & LIABILITY WAIVER. I understand that boating and water-related activities involve inherent risks including but not limited to: drowning, collision, capsizing, weather hazards, marine life encounters, equipment failure, slip and fall injuries, sun exposure, and other personal injury or death. I VOLUNTARILY ASSUME ALL SUCH RISKS and hereby release, waive, and forever discharge Pine Key Tampa Bay LLC, Beer Can Island Owners Club LLC, Tiki Bay Island LLC, and all of their respective owners, members, managers, officers, directors, board members, shareholders, equity holders, employees, agents, contractors, affiliates, successors, assigns, heirs, executors, family members, and insurers (collectively, the "Protected Parties") from any and all liability, claims, demands, and causes of action for injury, death, or property damage arising from or related to my participation in this charter service, whether caused by negligence or otherwise.

6. INDEMNIFICATION. I agree to indemnify and hold harmless all Protected Parties from any claims, damages, or expenses (including attorney's fees) arising from my actions or the actions of any member of my party during the charter.

7. DAMAGE TO VESSEL. I agree to be financially responsible for any damage to the vessel, its equipment, or furnishings caused by me or any member of my party beyond normal wear and tear.

8. INSURANCE. Neither Beer Can Island Owners Club LLC, Pine Key Tampa Bay LLC, nor Tiki Bay Island LLC provide any insurance coverage of any kind, including health, accident, travel, marine, liability, or property insurance. The customer is solely responsible for obtaining any insurance coverage they deem necessary. Proof of insurance is not required.

9. PLATFORM DISCLAIMER. Beer Can Island Owners Club LLC, Pine Key Tampa Bay LLC, and Tiki Bay Island LLC (collectively, "BCI") act solely as a booking platform connecting customers with independent service providers. BCI is not a party to the charter or rental service, does not own, operate, inspect, or maintain any vessel or equipment, does not employ or control any captain or crew, and assumes no liability whatsoever for any service, vessel, equipment, or any acts or omissions of any service provider, captain, crew, or operator.

10. PHOTO/VIDEO RELEASE. I grant the Charter Operator and BCI permission to use any photographs or videos taken during the charter for promotional purposes unless I notify the captain in writing prior to departure.

11. GOVERNING LAW & DISPUTE RESOLUTION. This agreement is governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Hillsborough County, Florida. I waive any right to a jury trial and agree that any claims will be brought solely in my individual capacity, not as part of a class action.
