Welcome to Beer Can Island. These Terms of Service ("Terms") govern your access to and use of the website beercanisland.net ("Site"), operated by Pine Key TampaBay LLC and Beer Can Island Owners Club LLC (collectively, "Company," "we," "us," or "our"). By accessing or using the Site, creating an account, purchasing a membership, or buying ownership shares, you agree to be bound by these Terms. If you do not agree, do not use the Site.
You must be at least 18 years of age to use this Site, create an account, or purchase any membership or ownership interest. By using the Site, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
Free memberships provide limited access to the Site and member portal. Free memberships do not include island access, tiki bar privileges, or drink tickets.
Monthly memberships are billed on a recurring basis via Stripe. Your membership will automatically renew each month until canceled. You may cancel at any time through your member dashboard; cancellation takes effect at the end of the current billing period.

Ownership shares represent genuine LLC equity units in Beer Can Island Owners Club LLC. Ownership is a one-time purchase and does not renew. Ownership shares are subject to the LLC Operating Agreement and may only be transferred through the Company's approved transfer process. A maximum of 1,500 total shares are available.
Membership fees are generally non-refundable. If you believe a charge was made in error, contact us within 30 days at Russ@beercanisland.com. Ownership share purchases are non-refundable and are subject to the LLC Operating Agreement.
Drink tickets purchased through the Site have no cash value and are redeemable only at the Beer Can Island Tiki Bar. Drink tickets are non-refundable, do not expire, and may be gifted to other registered members. The Company reserves the right to limit the quantity of tickets purchased per transaction.
Members may earn rewards (drink tickets or cash) by referring new members through their unique referral link. Referral rewards are subject to change at any time. The Company reserves the right to revoke referral rewards obtained through fraudulent or abusive activity, including self-referrals, fake accounts, or any other manipulation of the program.

All members and visitors to Beer Can Island must agree to our Liability Waiver as a condition of access. Beer Can Island is a natural, outdoor environment. You assume all risks associated with visiting the island, including but not limited to risks from water, weather, wildlife, terrain, boating, and alcohol consumption.
All content on this Site — including text, images, logos, graphics, and software — is the property of Pine Key TampaBay LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any Site content without prior written permission.
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information including tax identification numbers provided by shareholders.
THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINE KEY TAMPABAY LLC, BEER CAN ISLAND OWNERS CLUB LLC, AND THEIR OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.
You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, violation of these Terms, or infringement of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Hillsborough County, Florida.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify active members via email or dashboard notification.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, Liability Waiver, and LLC Operating Agreement, constitute the entire agreement between you and the Company regarding your use of the Site.
